TERMS OF SERVICE
These Terms of Service (“Terms”) set out the conditions governing the use of the online store, website, products, and related services operated by KOHAKUYA (“we,” “us,” or “our”), collectively referred to as the “Services.”
By browsing or using the Services, or by purchasing a product from us, you agree to these Terms and the policies published by our store. If you do not agree to these Terms, please do not use the Services.
SECTION 1 — ELIGIBILITY AND ACCOUNTS
You represent that you have reached the age at which you may legally enter into a contract in your country or region, or that you are using the Services with the consent of your legal guardian.
When purchasing a product, you might be asked to provide information such as your name, email address, shipping address, billing address, and payment details. You agree to provide accurate and current information.
You are responsible for appropriately managing your account and login information. You may not transfer, sell, or lend your account to another person.
SECTION 2 — PRODUCTS
We sell pre-owned and vintage goods, everyday items, miscellaneous goods, kimono, and traditional Japanese clothing and accessories.
Pre-owned and vintage items might show signs of age or previous use, including fading, odors, scratches, stains, repairs, or variations in measurements. We make reasonable efforts to describe each item’s condition accurately on its product page. Please understand the nature of these items before making a purchase.
The actual colors and appearance of a product might differ from the images displayed because of the device, screen settings, lighting conditions, or other viewing conditions.
Product descriptions, prices, availability, and sales conditions may be changed without notice when necessary.
SECTION 3 — ORDERS
When you submit an order, you are making an offer to purchase the products in that order. A sales contract is formed when we review the order and send you an order confirmation.
We may change or cancel all or part of an order because of insufficient inventory, an error in the price or product information, suspected fraud, shipping restrictions, or other unavoidable circumstances. In such cases, we will notify you using the contact information provided with your order.
We begin preparing orders for shipment after they are confirmed, and we might not be able to accept a cancellation request. If you would like to cancel an order, please contact us as soon as possible.
SECTION 4 — PRICES AND PAYMENT
Product prices are displayed on each product page. Unless otherwise stated, prices displayed to customers in Japan include applicable Japanese consumption tax.
For shipping fees, customs duties, import taxes, customs clearance fees, and other charges in addition to the product price, please refer to our Legal Notice and Shipping Policy.
Available payment methods are displayed at checkout. Payment is processed when your order is confirmed. The actual billing or debit date depends on the terms of your card issuer or payment provider.
You agree to provide accurate and valid payment information and represent that you are authorized to use the selected payment method.
SECTION 5 — SHIPPING
For shipping methods, shipping fees, processing times, eligible destinations, and other shipping conditions, please refer to our Shipping Policy and Legal Notice.
Estimated delivery dates are provided as a guide only. Delivery might be delayed because of the carrier, weather, customs procedures, transportation disruptions, natural disasters, or other circumstances beyond our reasonable control.

SECTION 6 — RETURNS, EXCHANGES, AND REFUNDS

Items returned without prior approval might not be accepted. If you would like to return an item, please contact us before sending it back.

• Infringing the rights of our store, Shopify, or any third party
• Providing false or misleading information
• Impersonating another person or organization
• Engaging in fraudulent payments, fraud, or money laundering
• Interfering with the operation of the Services
• Transmitting viruses, malware, or other harmful code
• Improperly collecting, using, or disclosing personal information belonging to us or a third party
• Engaging in harassment, threats, discrimination, defamation, or other inappropriate conduct

• Engaging in any other activity that we reasonably consider inappropriate
If we identify a prohibited activity, we may take necessary action, including suspending access to the Services, canceling an order, or suspending an account.

Copyrights, trademarks, and other intellectual property rights relating to the text, images, videos, logos, designs, product descriptions, and other content published through the Services belong to us or their respective lawful owners.
Except where permitted by law, including for personal use, you may not reproduce, republish, modify, distribute, sell, or publicly display this content without our prior permission.

The Services might use third-party providers for payment processing, shipping, analytics, apps, and other functions. The Services might also contain links to websites operated by third parties.
Third-party services are subject to the terms and privacy policies established by their respective providers. We do not guarantee the content, accuracy, security, or availability of third-party services or websites.
SECTION 10 — OUR RELATIONSHIP WITH SHOPIFY
The Services are operated using a platform provided by Shopify.
We are responsible for selling products, accepting orders, shipping products, processing returns and refunds, and providing customer support. Shopify is not the seller in any transaction between you and our store.

Because the Services use Shopify’s platform, Shopify might process personal information to the extent necessary to provide, secure, and improve the Services.
SECTION 12 — PRODUCT REVIEWS AND FEEDBACK
If you submit a product review, opinion, suggestion, or other feedback to us, you represent that you have all rights necessary to submit that content.
You must not submit content that infringes the rights of another person, contains false or unlawful information, is defamatory, discriminatory or obscene, discloses personal information, or contains harmful code.
We may hide, edit, or remove content that we reasonably consider inappropriate.
SECTION 13 — ERRORS AND CORRECTIONS
Product descriptions, prices, shipping fees, inventory availability, promotions, delivery estimates, and other information published through the Services might occasionally contain errors, display issues, or omissions.
If we discover an error, we may correct or update the information without prior notice and, when necessary, change or cancel an order. If we cancel an order that has already been paid for, we will refund the applicable amount.
SECTION 14 — CHANGES OR SUSPENSION OF THE SERVICES
We may change, temporarily suspend, or discontinue all or part of the Services when necessary because of maintenance, system failures, security concerns, natural disasters, legal requirements, or other circumstances.
We will provide advance notice when reasonably possible. In urgent situations, we might take action without prior notice.

We make reasonable efforts to provide accurate, secure, and continuous Services. However, we do not guarantee that the Services will always be uninterrupted or entirely free from errors or defects.

Nothing in these Terms limits any customer rights that cannot lawfully be limited or excluded under the Consumer Contract Act of Japan or other applicable laws.

If you violate these Terms or any applicable law, we may take necessary action, including canceling an order, suspending an account, or restricting access to the Services.
After access is suspended or a contract is terminated, provisions concerning payment obligations, intellectual property rights, limitation of liability, and any other provisions that by their nature should survive will remain in effect.
SECTION 17 — SEVERABILITY
If any provision of these Terms is determined by law or a court to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
SECTION 18 — CHANGES TO THESE TERMS
We may change these Terms when necessary because of changes in the law, changes to the Services, or other circumstances.
The revised Terms take effect when published on this page or on another date specified by us. If a material change is made, we will provide notice by a reasonable method in accordance with applicable law.
SECTION 19 — GOVERNING LAW AND JURISDICTION
These Terms and any contract relating to the Services are governed by the laws of Japan.
Unless otherwise provided by applicable law, the Fukuoka District Court will have exclusive jurisdiction as the court of first instance over any dispute arising from or relating to these Terms or the Services.
